Terms and Conditions

Welcome to Goencar Taxi (“Goencar Taxi App”). These Terms & Conditions (“Terms”) govern your use of our mobile application (the “Goencar Taxi App”) and related services (the “Ride Hailing Services”).

By using the App, you agree to be bound by these Terms for Using as Customers.

1. Eligibility:

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the App.

2. User Accounts:

• You are responsible for maintaining the confidentiality of your account information and password. You are also responsible for all activity that occurs under your account.
• Goencar Taxi reserves the right to deactivate your account for any violation of these Terms or suspicion of fraudulent activity.

3. Use of the Services:

• You agree to use the Services only for lawful purposes and in accordance with these Terms.
• You will not use the App in any way that could damage, disable, overburden, or impair the App or interfere with another user’s use of the Services.
• You are solely responsible for your conduct and interactions with drivers while using the Services.

4. Booking & Payment:

• You can request rides through the Goencar Taxi App.
• Before confirming a booking, you will see the driver’s bid (proposed fare) for your ride. This allows you to choose a ride that fits your budget.
• You agree to pay the final fare based on the confirmed driver’s bid, which may include a minimal Goencar Taxi platform fee ” ₹10 ” (deducted from your wallet or added to cash payment) and the ” 5% GST “, which you are responsible for paying.
• Goencar Taxi offers multiple payment options for your convenience: cash, any UPI platform, or directly from your Goencar Taxi wallet (topped up through the app).

5. Cancellations:

• You may cancel a ride request before a driver is assigned. Cancellation fees may apply based on the time of cancellation after a driver is assigned as outlined in the App.
• Drivers may also cancel rides due to unforeseen circumstances or passenger violations of these Terms.

6. Passenger Conduct:

• Maintain a clean and respectful environment within the vehicle. Avoid bringing strong-smelling food items or consuming food inside the car.
• Smoking, vaping, and consuming alcohol are strictly prohibited for passengers.
• Always wear your seatbelt for your safety.
• Be mindful of your belongings throughout the ride.
• Treat drivers with courtesy and respect.

7. Content:

• The App may contain content provided by users or third parties. We are not responsible for the accuracy or completeness of such content.

8. Disclaimers:

• The Services are provided “as is” and without warranties of any kind, express or implied. Goencar Taxi disclaims all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Goencar Taxi does not guarantee the availability, reliability, or timeliness of the Services.
• Goencar Taxi is not liable for any damages arising from the use of the Services, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages.

9. Limitation of Liability:

• In no event will Goencar Taxi be liable for any damages arising out of or in connection with your use of the Services.
• This limitation of liability applies to all claims, regardless of whether based on contract, tort, strict liability, or any other legal theory.

10. Indemnification:

You agree to indemnify and hold harmless Goencar Taxi, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorney’s fees) arising out of or in connection with your use of the Services or your violation of these Terms.

11. Termination:

Goencar Taxi may terminate your access to the Services at any time, with or without cause, and with or without notice.

12. Governing Law:

These Terms will be governed by and construed in accordance with the laws of India.

13. Entire Agreement:

These Terms constitute the entire agreement between you and Goencar Taxi with respect to your use of the Services.

14. Severability:

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

15. Updates to Terms:

Goencar Taxi may update these Terms & Conditions periodically. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after the posting of revised Terms constitutes your acceptance

By using the App and providing ride services, you agree to be bound by these Terms as drivers.

1. Eligibility:

• You must be at least 18 years old and possess a valid driver’s license for Goa, India.
• You must have all necessary permits and insurance coverage required for operating a taxi in Goa.
• You must pass a background check conducted by Goencar Taxi.

2. Driver Account:

• You are responsible for maintaining the confidentiality of your account information and password.
• You are solely responsible for all activity that occurs under your account.
• Goencar Taxi reserves the right to deactivate your account for any violation of these Terms, safety concerns, or suspicion of fraudulent activity.

3. Vehicle Requirements:

• You agree to use a vehicle that meets all safety standards and licensing requirements for taxi operation in Goa.
• Your vehicle must be clean, well-maintained, and in good working condition.

4. Using the App:

• Remain professional and courteous in all interactions with passengers.
• Uphold traffic laws and regulations while driving.
• Maintain a smoke-free and pet-free environment in your vehicle.
• Respect passenger privacy and avoid sharing personal information.
• Only accept ride requests through the Goencar Taxi Driver App.
• Respond promptly to ride requests and arrive on time for pick-ups.
• Passengers can choose their preferred ride option (daily, scheduled, outstation, full-day).
• You have the option to set your own bid (proposed fare) for each ride within a reasonable range.
• Passengers can see your profile picture, car model & rating before accepting your ride.
• Use the in-app chat or phone call function to communicate directly with passengers for route clarification.
• Navigate efficiently and choose the safest route possible.

5. Fares & Earnings:

• You collect the full fare amount directly from passengers after completing the ride.
• Passengers can pay by cash, any UPI platform, or directly from their wallet using your mobile number.
• Goencar Taxi charges a minimal service fee of ₹50 + ₹10 platform fee per confirmed booking, deducted from your wallet once you completed your ride .
• You are responsible for collecting the ₹10 platform fee from passengers.

6. Driver Conduct & Safety:

• Maintain a clean driving record and inform Goencar Taxi of any traffic violations.
• Report any safety concerns or passenger misconduct immediately to Goencar Taxi support.
• Refrain from consuming alcohol or drugs while using the App.
• Secure all passenger belongings left in your vehicle.
• Goencar Taxi reserves the right to deactivate your account for any violation of safety protocols.

7. App Usage & Availability:

• You are responsible for maintaining a smartphone with a reliable internet connection to use the App.
• Goencar Taxi may experience periods of downtime or technical issues. We will make every effort to resolve these issues promptly.

8. Support & Communication:

• Goencar Taxi offers a 24/7 support system via phone call, in-app live chat, or ticket raise system for any assistance.
• We encourage open communication and prompt reporting of any issues or concerns.

9. Ratings & Reviews:

• Passengers can rate their rides based on your service and professionalism.
• Maintaining a high rating (5-star) can lead to increased ride requests and potentially higher earnings.
• We encourage you to provide constructive feedback to passengers if necessary.

10. Independent Contractor:

• You acknowledge that you are an independent contractor and not an employee of Goencar Taxi.

11. Indemnification:

You agree to indemnify and hold harmless Goencar Taxi, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorney’s fees) arising out of or in connection with your use of the Services or your violation of these Terms.

12. Termination:

Goencar Taxi may terminate your access to the Services at any time, with or without cause, and with or without notice.

13. Governing Law:

These Terms will be governed by and construed in accordance with the laws of India.

14. Entire Agreement:

These Terms constitute the entire agreement between you and Goencar Taxi with respect to your use of the Services.

16. Updates to Terms:

Goencar Taxi may update these Terms & Conditions periodically. We will notify you of any changes by posting the new Terms on the Goencar Taxi Driver App. Your continued use of the App and participation as a driver on the platform after the posting of revised Terms constitutes your acceptance of the updated Terms.

17. Dispute Resolution:

Any dispute arising out of or in connection with these Terms will be settled through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Goa, India.

18. Additional Policies:

Goencar Taxi reserves the right to implement additional policies or guidelines for drivers to ensure a safe and professional ride-hailing experience for all users. These policies may be communicated through the App or driver portal.

19. Feedback & Suggestions:

We value your feedback! We encourage you to provide suggestions for improvement of the Goencar Taxi platform and driver experience. This can be done through the in-app feedback section or by contacting driver support.

By using the Goencar Taxi Driver App and providing ride services through the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
